Welcome to FOOTCRAFTER! FOOTCRAFTER is a trading name and brand operated by Alpha Byte Technology Limited. Throughout the site, the terms “we”, “us” and “our” refer to Alpha Byte Technology Limited (doing business as FOOTCRAFTER).
Alpha Byte Technology Limited offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. These services include the ARRCH mobile scanning application (the "App" or "ARRCH"), which enables us to collect measurement data for our products. FOOTCRAFTER is powered by Shopify, which enables us to provide the e-commerce platform to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the website, the App, or purchase our products (collectively, the “Services”).
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state, or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing our online stores, using the App for scanning, or purchasing any products, you may be asked to provide certain information, such as your email address, billing, payment, shipping information, and biometric data (such as foot scans and photos). You represent and warrant that all the information you provide is correct, current, and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS AND SCANS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration. We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations.
Scan Accuracy: You explicitly acknowledge that the quality, fit, and effectiveness of our custom products depend entirely on the accuracy of the data, scans, and photos you submit via the ARRCH App. We are not responsible or liable for ill-fitting products resulting from poor-quality scans, improper use of the App, or failure to carefully follow our provided scanning instructions.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS, CANCELLATIONS, AND REFUNDS
When you place an order, you are making an offer to purchase. FOOTCRAFTER reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until FOOTCRAFTER confirms acceptance. We must receive and process your payment before your order is accepted.
No Cancellations: Because each pair of FOOTCRAFTER insoles is custom-made to your unique feet, orders cannot be canceled, altered, or reversed once you have checked out. Production begins immediately following order verification.
Strictly Non-Refundable: Because our products are entirely personalized, all purchases of custom orthotics are final. We cannot accept returns, issue refunds, or offer standard exchanges for custom items unless the item arrives damaged or defective as specified in our Return & Cancellation Policy.
Commercial Resale: You represent and warrant that your purchases are for your own personal use and not for commercial resale, distribution, or unauthorized export.

SECTION 4 - PRICES, BILLING, AND INTERNATIONAL CUSTOMS
Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Local Orders: Standard shipping within Hong Kong is included in the posted price.
International Orders & Duties: For shipments outside of Hong Kong (as service becomes available), posted prices do not include international import duties, customs fees, processing fees, or local cross-border taxes (e.g., VAT/GST). All such inbound customs clearances, tariffs, and local taxes are the sole responsibility of the customer/importer.
Payment Authorization: You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use such payment method, and (iii) you will pay all charges incurred by you at the posted prices, including any applicable shipping options or cross-border fees.

SECTION 5 - SHIPPING, DELIVERY, AND FREIGHT FORWARDING
All delivery times provided are estimates only and are not guaranteed. We are not liable for shipping and delivery delays caused by shipping carriers, customs clearance delays, or events outside our reasonable control. Once we transfer the products to the shipping carrier, title and risk of physical loss pass entirely to you.
If you choose to use a third-party freight forwarding or mail redirection service to transport your package outside of our official local shipping zones, you do so at your own risk. FOOTCRAFTER is only responsible for logistics and safe delivery to the designated Hong Kong delivery address provided during checkout.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to the ARRCH App, all storefronts, trademarks, brands, text, designs, 3D modelling algorithms, software, images, graphics, video, and audio, are owned by Alpha Byte Technology Limited, its affiliates, or licensors and are protected by Hong Kong and international patent, copyright, trademark, and intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, reverse engineer, decompile, or disassemble any aspect of the website or the App without our prior written consent. The names FOOTCRAFTER and ARRCH, along with all related logos, product names, and slogans, are proprietary trademarks of Alpha Byte Technology Limited.

SECTION 7 - OPTIONAL TOOLS
We may provide you with access to third-party tools as part of our Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content, safety, or accuracy of any third-party materials. We are not liable for any harm or damages related to your purchase or use of goods, services, or resources connected with any third-party websites.  

SECTION 9 - RELATIONSHIP WITH SHOPIFY
FOOTCRAFTER is hosted on an e-commerce platform provided by Shopify. However, any sales and purchases you make in our store are made directly with Alpha Byte Technology Limited. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales or interactions between you and FOOTCRAFTER, including any injury, damage, or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with FOOTCRAFTER.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services (including data, depth maps, and photographs captured via the ARRCH App) is subject to our Privacy Policy. By using the Services, you acknowledge that you have read and understood our data processing and retention practices as outlined in our Privacy Policy.

SECTION 11 - CUSTOMER FEEDBACK AND REVIEWS
If you submit or post reviews, ideas, suggestions, or testimonials (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including for commercial marketing.
You agree that your Feedback will not violate any right of any third party, will not contain defamatory or unlawful material, and will not contain malware or viruses. You are solely responsible for the accuracy of any Feedback you make.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on our storefront or within the App that contains typographical errors, inaccuracies, or omissions relating to product descriptions, sizing guidance, pricing, promotions, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 13 - PROHIBITED USES
In addition to other prohibitions set forth in these Terms, you are prohibited from using the website, the App, or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, local, or regional regulations, rules, or laws; (d) to infringe upon or violate our intellectual property rights or the rights of others; (e) to submit false, altered, or fraudulent foot scan data; (f) to upload or transmit viruses, malicious code, or scrapers; or (g) to reverse engineer or attempt to extract the source code of the ARRCH mobile application. Violation of any prohibited uses will result in immediate termination of your account and access to the Services.  

SECTION 14 - TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Provisions that by their nature should survive termination shall survive, including Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and the Medical Disclaimer.

SECTION 15 - DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY STATED BY US, THE SERVICES (INCLUDING THE APP) AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

SECTION 16 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL ALPHA BYTE TECHNOLOGY LIMITED, FOOTCRAFTER, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, MANUFACTURING PARTNERS, OR SERVICE PROVIDERS, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Alpha Byte Technology Limited, FOOTCRAFTER, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, and manufacturing providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, made by any third party due to or arising out of (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your misuse of the ARRCH App or custom products.

SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 19 - ENTIRE AGREEMENT
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us.  

SECTION 20 - GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR). You and Alpha Byte Technology Limited explicitly agree that any legal dispute, claim, or proceeding arising under or relating to these Terms or the purchase of our products shall be subject to the exclusive jurisdiction of the courts of Hong Kong.  

SECTION 21 – MEDICAL DISCLAIMER (CUSTOM ORTHOTICS & SCANS)
The products, services, content, and information provided by FOOTCRAFTER (including via the App), such as custom orthotics, insoles, fitting tools, sizing guidance, 3D scans, questionnaires, recommendations, and educational materials, are provided for general wellness and informational purposes only and do not constitute medical or healthcare services, medical advice, diagnosis, prescription, or clinical treatment of any kind.
FOOTCRAFTER is not a medical provider and does not employ licensed healthcare practitioners for the purpose of diagnosing, treating, curing, or preventing any medical condition. Nothing on this website or in connection with the Services should be interpreted as a substitute for professional medical advice from a licensed physician, podiatrist, orthopedist, or other qualified healthcare provider.
You expressly acknowledge and agree that:
Custom orthotics and related products sold by FOOTCRAFTER are not registered medical devices, unless explicitly stated otherwise in writing by FOOTCRAFTER.
FOOTCRAFTER does not diagnose, treat, prescribe for, or prevent any medical or health condition.
Any product selection guidance, fitting recommendations, questionnaires, scans, or data collection (via the App or otherwise) are provided solely to assist with product customization and do not constitute a medical evaluation, clinical service, or professional healthcare judgment.
Individual anatomical outcomes vary, and no claim, guarantee, or assurance is made regarding improvement, relief, or prevention of any medical condition, injury, or pain.
Misuse, improper fitting, prolonged use, failure to follow break-in instructions, or failure to consult a qualified medical professional may result in discomfort, injury, worsening conditions, or ineffective results.
You agree that you are solely responsible for determining whether any product purchased is suitable for your personal condition, activity level, or health status. You assume all risks associated with the use or misuse of any product purchased through the Services. If you experience pain, numbness, inflammation, worsening symptoms, or any other medical concern, you must discontinue use immediately and consult a licensed healthcare provider.
To the fullest extent permitted by law, Alpha Byte Technology Limited disclaims all liability for any medical-related outcomes, injuries, or conditions arising from the purchase, use, or misuse of its products and scanning tools.
